These Terms of Service ("Terms") govern your access to and use of the PoolWorks AI Service. By creating an account or using the Service, you agree to these Terms.
1. The Service
PoolWorks AI is a software platform for pool service businesses, providing customer records, route building, visit logging, and related tools. The Service is provided "as is" and "as available."
2. Accounts
You are responsible for maintaining the security of your account and for all activity under it. Notify us immediately of any unauthorized use.
3. Subscription and billing
Paid plans are billed monthly in advance. Prices are listed at poolworksai.com/#pricing. You may cancel at any time; cancellation is effective at the end of the current billing period. No refunds for partial periods except as required by law.
4. Customer data and acceptable use
You retain ownership of all data you upload ("Customer Data"). You grant us a limited license to host and process Customer Data solely to provide the Service. You agree not to use the Service to violate any law, infringe any rights, or harass any person.
5. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL POOLWORKS AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS.
7. Indemnification
You agree to defend and indemnify us from any third-party claim arising out of your Customer Data, your use of the Service, or your breach of these Terms.
8. Termination
We may suspend or terminate your access for material breach of these Terms. You may terminate at any time by closing your account.
9. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Palm Beach County, Florida.
10. Changes
We may modify these Terms with reasonable notice. Continued use after changes take effect constitutes acceptance.
